Terms & Conditions

These Terms and Conditions (“Terms”) govern all services, bookings, agreements, and interactions between Oblivion Eden Inc. (“Company,” “we,” “our,” or “us”) and the client (“Client,” “you,” or “your”). By booking, contracting, or engaging our services, you acknowledge that you have read, understood, and agreed to these Terms in full.

1. Services & Scope of Work

Oblivion Eden Inc. provides professional event production, audio, lighting, technical direction, and experiential services as outlined in written proposals, invoices, or contracts.
The scope of work is limited strictly to what is documented in the agreed-upon service agreement. Any additional services requested outside of the original scope may result in additional fees.

2. Booking, Deposits & Payment

  • A non-refundable deposit (typically 30–50%) is required to secure the event date.

  • The remaining balance is due no later than 7 days prior to the event, unless otherwise stated in writing.

  • Failure to remit full payment by the due date may result in cancellation of services without refund.

  • Payments made after the due date may be subject to late fees.

3. Cancellations & Rescheduling

  • Deposits are non-refundable under all circumstances.

  • Cancellations within 30 days of the event may result in the Client being responsible for up to 100% of the total contracted amount.

  • Rescheduling requests are subject to availability and may incur additional fees.

  • Oblivion Eden Inc. reserves the right to cancel services due to unsafe conditions, non-payment, or breach of these Terms.

4. Client Responsibilities

The Client agrees to:

  • Provide accurate event details, timelines, and venue information.

  • Secure all required permits, licenses, and venue approvals.

  • Ensure safe access, adequate power, and load-in/load-out conditions.

  • Be responsible for guest behavior and compliance with venue rules.

Oblivion Eden Inc. is not responsible for delays or performance issues caused by venue restrictions, late timelines, or incomplete client-provided information.

5. Equipment & Damage

  • All equipment remains the property of Oblivion Eden Inc.

  • The Client assumes full responsibility for damage, loss, or theft of equipment caused by guests, vendors, or venue staff.

  • Repair or replacement costs will be billed to the Client at full replacement value if damage occurs.

6. Event Timing & Overtime

Services are provided for the agreed-upon time window.
Overtime is subject to availability and billed at an hourly rate as outlined in the service agreement.
Unauthorized use of equipment beyond contracted hours may incur additional charges.

7. Artistic Discretion

Oblivion Eden Inc. retains creative and technical discretion regarding sound levels, lighting execution, and operational decisions to maintain quality, safety, and professional standards.

8. Force Majeure

Oblivion Eden Inc. shall not be held liable for failure to perform services due to events beyond reasonable control, including but not limited to:

  • Acts of God

  • Severe weather

  • Government restrictions

  • Power failures

  • Emergencies or safety threats

In such cases, deposits remain non-refundable.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Oblivion Eden Inc. shall not be liable for indirect, incidental, or consequential damages.

  • Our total liability shall not exceed the total amount paid by the Client for services.

  • We are not responsible for lost profits, reputational damage, or event outcomes beyond technical execution.

10. Indemnification

The Client agrees to indemnify and hold harmless Oblivion Eden Inc., its employees, contractors, and affiliates from any claims, damages, liabilities, or expenses arising from:

  • Client negligence

  • Guest actions

  • Venue conditions

  • Breach of these Terms

11. Media & Documentation

Unless otherwise agreed in writing, Oblivion Eden Inc. reserves the right to photograph or document events for portfolio, marketing, and promotional use.
Clients may opt out by submitting a written request prior to the event date.

12. Governing Law

These Terms shall be governed and interpreted in accordance with the laws of the state in which Oblivion Eden Inc. is registered and operates, without regard to conflict-of-law principles.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

14. Acceptance of Terms

By booking or engaging Oblivion Eden Inc., the Client confirms acceptance of these Terms and Conditions in full.
